This Legal Notice sets out the intellectual property rights, disclaimers, limitations of liability, and legal provisions that apply to your use of the Heart & Hearth Pottery website, studio, and Services. It supplements the Terms & Conditions and is incorporated by reference into every agreement with the studio.

6.2 Intellectual Property Rights

All content on the Heart & Hearth Pottery website and in studio materials — including the name "Heart & Hearth Pottery," the logo, text, graphics, photographs, videos, illustrations, course curriculum, class descriptions, program names, audio recordings, and the arrangement and selection of the foregoing — is the exclusive property of Heart & Hearth Pottery and is protected by United States and international copyright, trademark, and other intellectual property laws.

The name "Heart & Hearth Pottery," any associated logos, and distinctive brand elements are trademarks of the studio. Use of these marks without prior written permission is prohibited.

6.3 Permitted Use

You may view, download, and print content from the website solely for your personal, non-commercial use, provided you retain all copyright and proprietary notices. You may share class details, promotional posts, and public announcements on social media with attribution.

Any other use — including reproduction, modification, distribution, transmission, republication, commercial use, or derivative works — requires the prior written consent of the studio.

6.4 Prohibited Use

• Reproducing studio curriculum, class plans, or written materials for use in another studio, classroom, or commercial setting.

• Using studio photographs, videos, or student work for commercial purposes without written consent.

• Scraping, data mining, or automated extraction of content from the website.

• Using the studio's name, logo, or marks to imply endorsement, partnership, or affiliation that does not exist.

• Framing the website or content on another site without written permission.

6.5 Student Work & Original Creative Expression

Student work created in class remains the creative property of the student. The studio does not claim ownership over finished pieces made by students. However, the studio retains the right to photograph, display, and share images of student work for educational, promotional, and archival purposes in accordance with the Media Release signed at intake.

Instructional techniques, demonstrations, project designs, and curriculum developed by the studio remain the property of Heart & Hearth Pottery. Students agree not to reproduce, teach, or commercialize studio-originated curriculum elsewhere without written permission.

6.6 User Submissions & Feedback

If you submit comments, suggestions, testimonials, photographs, or other content to the studio (whether by email, form, social media tag, or otherwise), you grant Heart & Hearth Pottery a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, and adapt that content for studio purposes, including marketing and promotional use.

You represent that you own or have the right to submit any content you provide and that it does not violate the rights of any third party.

6.7 Third-Party Links & Content

The website and studio communications may contain links to third-party websites, services, or resources that are not owned or controlled by Heart & Hearth Pottery. We provide these links for convenience and do not endorse, monitor, or assume responsibility for the content, privacy practices, or policies of any third-party site.

Your use of third-party websites is at your own risk and subject to the terms and policies of those sites.

6.8 General Disclaimer

The website, Services, and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

The studio does not warrant that the website will be error-free, secure, or continuously available, or that information on the website is complete, current, or accurate. Class schedules, pricing, and availability are subject to change without notice.

6.9 Ceramic Outcomes Disclaimer

Ceramic processes involve kilns, chemical reactions, and physical variables that are not fully controllable. The studio does not warrant or guarantee the success, appearance, durability, functionality, food safety, or survival of any student-made piece. See Section 2.14 of the Refund, Return & Studio Care Policy for details.

6.10 Limitation of Liability

To the maximum extent permitted by law, Heart & Hearth Pottery, its owner, instructors, employees, volunteers, agents, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the website, Services, studio, or any content, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.

Physical injury, property damage, and personal risk in the studio are addressed separately in the Liability Waiver signed at intake and are not covered by this Legal Notice.

Nothing in this Legal Notice excludes or limits liability that cannot be excluded or limited under applicable law, including gross negligence, willful misconduct, or consumer protections required by California law.

6.11 Indemnification

You agree to defend, indemnify, and hold harmless Heart & Hearth Pottery, its owner, instructors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of any third-party right, or your use of the Services in a manner inconsistent with stated policies.

6.12 DMCA & Copyright Infringement Claims

If you believe content on the website infringes your copyright, submit a written notice to studio@heartandhearthpottery.com that includes:

• Identification of the copyrighted work you believe has been infringed.

• The URL or specific location of the allegedly infringing material.

• Your contact information (name, address, telephone, email).

• A statement of good-faith belief that the use is not authorized.

• A statement under penalty of perjury that the information is accurate and you are authorized to act.

• Your physical or electronic signature.

6.13 Governing Law

These Terms, this Legal Notice, and all related policies are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Venue for any dispute that is not subject to arbitration shall be in the state or federal courts located in Los Angeles County, California.

6.14 Dispute Resolution

We prefer to resolve concerns directly and promptly. Please contact the studio in writing at studio@heartandhearthpottery.com to raise any dispute. If the dispute cannot be resolved informally within 30 days, either party may pursue available remedies in accordance with governing law.

Nothing in this section prevents either party from seeking injunctive or equitable relief in an appropriate court to protect intellectual property or confidential information.

6.15 Severability

If any provision of these Terms or this Legal Notice is held to be invalid, unlawful, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

6.16 No Waiver

Failure by the studio to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by the studio.

6.17 Entire Agreement

These Terms, together with the Refund, Return & Studio Care Policy, Privacy Policy, Accessibility Statement, Shipping Policy, Purchase Options & Cancellation Policy, Liability Waiver, Media Release, and Membership Agreement (where applicable), constitute the entire agreement between you and Heart & Hearth Pottery with respect to the Services and supersede all prior or contemporaneous understandings.

6.18 Updates to This Legal Notice

The studio may update this Legal Notice from time to time. The version and effective date appear at the top of this document. Material changes will be posted on the website and communicated by email to active students and members.
